Can a landlord refuse subletting in Texas?

Yes. Texas law bars a tenant from subletting without the landlord's prior consent, and the landlord can refuse for almost any reason.

Texas Property Code § 91.005

  • Section 91.005 says a tenant may not rent the leasehold to anyone else without the landlord's prior consent. There is no reasonableness requirement unless your lease adds one.
  • Even with consent, the original tenant stays fully liable on the lease. Subletting without consent lets the landlord evict the subtenant and sue you for damages.
  • Get written consent first, then document the student-to-student terms in a signed sublease.
