A sublease agreement is a written contract between a tenant who is leaving and the person moving in for part of the lease. It sets the rent, the dates and who is responsible for what, while the original lease stays in place.

What goes in a sublease agreement

These are the sections of the agreement Avouch writes, in order.

Common questions

Is there a sublease agreement for my state?

Yes. There is a page for every state and D.C. with the same agreement, and 15 of them also explain that state's subletting rules.

Is an e-signed sublease valid?

Yes. Under the federal ESIGN Act and UETA, a signature cannot be denied legal effect just because it is electronic. It does not override your lease, so get your landlord's consent if your lease requires it.
